By accessing or using HELSI (“the Service”), including our website at helsi.ai and any associated mobile applications, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must not use the Service.

HELSI is operated by HELSI (“we”, “our”, or “us”). These Terms constitute a legally binding agreement between you and HELSI.

2. Description of Service

HELSI is an AI-powered nutrition intelligence platform that helps people with diabetes make informed food decisions. The Service provides:

  • Food product barcode scanning and nutritional data retrieval
  • Glycemic Index (GI) and Glycemic Load (GL) calculations
  • Traffic light food safety indicators
  • Insulin dose estimations based on user-provided personal coefficients
  • Food journaling and meal tracking
  • Blood sugar logging and trend analysis

3. Medical Disclaimer

IMPORTANT: HELSI is not a medical device and does not provide medical advice, diagnosis, or treatment. All information provided by the Service — including glycemic calculations, insulin dose estimations, and food safety ratings — is for informational and educational purposes only.

Insulin dose estimations are calculated based on coefficients you provide (insulin-to-carb ratio, correction factor) and are estimates only. They should never replace the guidance of your endocrinologist, diabetologist, or other qualified healthcare professional.

Always consult your healthcare provider before making changes to your insulin regimen, diet, or diabetes management plan. In case of a medical emergency, contact your local emergency services immediately.

4. Eligibility

You must be at least 16 years old to use the Service. By using HELSI, you represent and warrant that you meet this age requirement. If you are between 16 and 18 years old, you must have permission from a parent or legal guardian.

5. User Accounts

When you create an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised access
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

6. Health Data and Personal Responsibility

HELSI may process health-related data that you voluntarily provide, including blood sugar readings, insulin ratios, and dietary information. By providing this data, you acknowledge that:

  • You are solely responsible for the accuracy of the health data you enter.
  • Incorrect input (e.g., wrong insulin-to-carb ratio) may lead to inaccurate estimations.
  • You should always verify estimations with your healthcare provider.
  • HELSI is not liable for any health outcomes resulting from reliance on the Service.

7. Nutritional Data Accuracy

Nutritional information displayed in HELSI is sourced from third-party databases including Open Food Facts, USDA, and other public and proprietary sources. While we strive for accuracy, we cannot guarantee that all nutritional data is complete, current, or error-free.

Glycemic index values may vary based on food preparation method, ripeness, brand, and individual metabolic response. The values provided are general estimates based on published scientific data.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, crawl, or harvest data from the Service without authorisation
  • Impersonate another person or misrepresent your affiliation
  • Use the Service to provide medical advice to others
  • Redistribute HELSI data or features commercially without written permission

9. Intellectual Property

All content, features, functionality, designs, algorithms, and trademarks of the Service are owned by HELSI and are protected by international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

User-generated content (e.g., food journal entries) remains your property, but you grant us a limited licence to process it for the purpose of providing and improving the Service.

10. Subscription and Payments

HELSI may offer both free and premium subscription tiers. Premium features may include advanced insulin calculations, AI-powered insights, and extended glucose analysis.

  • Subscription fees are billed in advance on a recurring basis (monthly or annually).
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with 30 days' notice.
  • Refunds are handled in accordance with applicable consumer protection laws.

11. Limitation of Liability

To the maximum extent permitted by law, HELSI and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, or goodwill
  • Any personal injury or health outcomes resulting from your use of or reliance on the Service
  • Any inaccuracy in nutritional data, glycemic calculations, or insulin estimations
  • Any interruption or unavailability of the Service

Our total aggregate liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

12. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that any nutritional or health-related data will be accurate or complete.

13. Indemnification

You agree to indemnify and hold harmless HELSI and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination shall survive (including Limitation of Liability, Indemnification, and Intellectual Property).

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the European Union and the applicable laws of the jurisdiction in which HELSI is registered. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to the competent courts of the jurisdiction in which HELSI is registered.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting an updated version on our website with a new “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
